On September 16, 2014 STURBLE, P.A. filed lawsuits against insurers who improperly denied homeowners’ insurance claims for water damages.  In one case, a home sustained substantial damage after a pipe located underneath the foundation broke.  The homeowner contacted a plumber who had to create holes in the flooring to access the pipe to repair it. The insurance company denied the insurance claim after claiming that the loss was caused by wear and tear. 

The insurance company’s denial of the claim was improper because the wear and tear exclusion does not apply to the water damage at issue.  Additionally, the policy specifically provides coverage for the costs associated with accessing the pipe, which constitutes a majority of the claim.
